A new episode clarifies the U.S. Endangered Species Act's (ESA) Sections 7 and 10. While the ESA strictly protects species, these sections provide mechanisms to limit "take" (harm) during activities.

Section 7 mandates federal agency consultation with the U.S. Fish and Wildlife Service and NOAA for actions affecting listed species, leading to an incidental take statement. Conversely, Section 10 allows individuals and organizations to obtain Incidental Take Permits (ITPs) for non-federal projects via a Habitat Conservation Plan (HCP). The key difference is federal agency involvement (Section 7) versus private landowners (Section 10). However, issuing a Section 10 ITP is a federal action, so HCPs always require an accompanying Section 7 consultation.
